These Terms and Conditions of Use ("TCU") govern your access to and use
of the Histoply application (the "Service"), accessible via the
histoply.app website and associated mobile applications, and provided by
Histoply SASU ("Histoply", "we", "us", "our").
By creating an account or using our Service, you agree to be bound by these TCU and by our Privacy Policy. If you do not agree to these terms, you must not use the Service.
Histoply is an online learning platform (SaaS) dedicated to history. The Service offers educational lessons, quizzes, and a spaced repetition system (SRS) to help users learn and memorize historical facts.
Access to the Service requires creating an account, including via third-party authentication services like Google Sign-In. You are responsible for the security of your account and all activities that occur under it. You agree to provide accurate information during registration.
The Service and all its components (the software, design, the "Histoply" trademark, texts, lessons, quiz questions, images, and any other educational content created by us) (the "Histoply Content") are and will remain the exclusive property of Histoply and its licensors.
The Histoply Content is protected by copyright, trademark, and other French and international laws.
Subject to your compliance with these TCU, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes.
You retain ownership of the data you generate while using the Service (e.g., your quiz answers, personal notes, progression data) (the "User Content").
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content for the sole purpose of providing the Service to you (e.g., to power your personalized SRS algorithm and synchronize your progress).
You agree not to:
You may terminate these TCU at any time by deleting your Histoply account.
We reserve the right to suspend or terminate your access to the Service, without notice, in the event of a serious breach of these TCU.
The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied.
To the fullest extent permitted by law, Histoply (including its founders, officers, and employees) shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data, profits, or opportunities) resulting from your use or inability to use the Service.
We may revise these TCU from time to time. We will notify you of significant changes. By continuing to use the Service after these changes take effect, you agree to be bound by the revised terms.
These TCU are governed and interpreted in accordance with French law.
In the event of a dispute, and after an attempt at amicable resolution, the competent courts of Paris shall have sole jurisdiction to settle the litigation.
